Documents Required from Buyers

  • Valid passport or DNI

  • NIE number (Número de Identificación de Extranjero)

  • Tax identification number in the home country

  • Proof of financing or proof of funds

  • Power of attorney (if purchasing through a representative)

  • Proof of marital status (single, married, marital property regime)

  • Bank details for notary and tax payments​

Documents Required from Sellers

  • Escritura (title deed)

  • Nota Simple (current ownership and encumbrance extract)

  • Cadastre extract

  • Energy certificate (CEE)

  • IBI receipts from recent years

  • Waste collection fee receipts

  • Community certificate (no outstanding payments)

  • Water and electricity bills

  • Certificate of occupancy (if available)

  • Power of attorney (if seller is not present)

  • Marriage contract or marital property regime (Gananciales / Separate Property)

Documents for the Legal Review (AMV Due‑Diligence)

  • Cross‑check of Escritura ↔ Cadastre ↔ physical reality

  • Building files and permits

  • Certificate of outstanding taxes (IBI, Plusvalía)

  • Certificate of outstanding charges (mortgages, embargoes)

  • Community statutes

  • Payment records for the last 12 months

  • Identity verification of all parties (KYC)

  • Verification of marital property regime (Gananciales / Separación de Bienes)

Risks When Documents Are Missing

  • Delays at the notary appointment

  • Purchase price cannot be released

  • Plusvalía tax cannot be calculated

  • Transfer of ownership may be blocked

  • Liability risks related to marital property regimes

  • Unclear charges or outstanding debts

  • Reversal of the transaction or refusal by the notary
